The following sections provide specific MMMJUA eligibility criteria, coverage details, and the application process.

The Missouri Medical Malpractice Joint Underwriting Association (MMMJUA) offers medical malpractice insurance to eligible Missouri providers and facilities.

Coverage

The MMMJUA writes Claims-Made Forms of Health Care Professional Liability and General Liability coverage for eligible providers and provider facilities.

Claims-Made is defined as a policy form that covers claims that are asserted and reported during the policy period for acts or omissions, giving rise to the claim, on or after the retroactive date. Upon discontinuation of claims-made coverage, the provider should consider whether they wish to purchase Extended Reporting Period or “tail” coverage to extend the time in which claims can be reported beyond the policy period.

An optional Extended Reporting Period or “tail” coverage may be offered when a provider discontinues claims-made coverage with the MMMJUA. This coverage extends liability protection to cover claims asserted and reported after the provider discontinues claims-made coverage with the MMMJUA that arises from acts or omissions that occurred on or after the retroactive date and prior to the termination date of the policy. Extended Reporting Period coverage quotes are provided upon request and are available for a reporting period of up to three years.

Limits of coverage offered are $1,000,000 per incident subject to an annual aggregate of $3,000,000, or $500,000 per incident subject to an annual aggregate of $1,500,000, for the professional liability policies. The same coverage limit amounts are offered separately for General Liability coverage. Separate limits are available for professional corporations of physician groups.

According to Missouri Statute, the plan is assessable to the casualty insurance companies licensed to write business in the state. It is, therefore, not assessable to its policy holders, and is also not subject to the protection of the Missouri Guaranty Fund.

Once complete application information has been received by the JUA underwriter, a quote letter will be forwarded to the provider. If application information is incomplete, a letter will be issued requesting additional information. If there is sufficient information provided to calculate a quote, the JUA will provide a provisional quote subject to the receipt of any additional information that is required in order to complete the application.
